1. Scope of These Terms
These Terms of Application ("Application Terms") govern your submission of a loan application, funding request, or any related inquiry through the Capitari website or affiliated platforms. By submitting an application, you agree to these Application Terms in addition to our Terms of Use and Privacy Policy.
2. Accuracy of Information
You represent and warrant that all information provided in your application is true, accurate, complete, and current. This includes, but is not limited to, your personal information, business information, financial data, revenue figures, tax identification numbers, and any supporting documentation. You understand that providing false, misleading, or incomplete information may result in the denial of your application and may constitute fraud under applicable law.
3. Authorization to Verify Information
By submitting an application, you authorize Capitari and its lending partners, service providers, and agents to:
- Verify the information provided in your application through any means deemed necessary, including contacting your bank, employer, references, and other third parties
- Obtain your personal and business credit reports from one or more consumer reporting agencies
- Access public records, business databases, and other information sources to confirm your identity and business details
- Share your application information with third-party lenders, financial institutions, and funding partners for the purpose of evaluating your application
- Conduct ongoing monitoring of your credit profile during the term of any financing arrangement

4. No Guarantee of Approval
Submitting an application does not guarantee that you will receive a loan, line of credit, or any other form of financing. All applications are subject to review, underwriting, and approval based on various factors including, but not limited to, creditworthiness, business performance, time in business, industry, and the availability of suitable lending products. Capitari reserves the right to decline any application for any reason permitted by law.
5. Third-Party Lenders and Partners
Capitari operates as a facilitator connecting businesses with potential lending partners. We are not a direct lender. Your application may be shared with one or more third-party lenders, financial institutions, or funding partners who will independently evaluate your application and determine whether to extend an offer. Any financing agreement you enter into will be directly between you and the third-party lender, subject to that lender's own terms and conditions. Capitari is not a party to any such financing agreement and is not responsible for the terms, rates, or conditions offered by third-party lenders.
6. Use of Application Data
Information submitted through your application will be used in accordance with our Privacy Policy. In addition to the uses described there, your application data may be used to:
- Match you with lending products that may meet your financing needs
- Provide your information to multiple lenders simultaneously to increase the likelihood of approval
- Contact you regarding the status of your application and potential financing options
- Send you marketing communications about related financial products, unless you opt out
7. Withdrawal of Application
You may withdraw your application at any time prior to entering into a financing agreement with a third-party lender by contacting us at contact@capitari.com or calling (888) 312-8055. Please note that withdrawal does not affect any credit inquiries that may have already been conducted or information that has already been shared with lending partners.
8. Communication Consent
By submitting an application, you consent to receive communications from Capitari and its partners by phone, email, text message, and mail regarding your application and related products. 9. Electronic Consent
By submitting your application electronically, you consent to receive all application-related documents, disclosures, and communications in electronic format. For full details, please review our Electronic Disclosure and Consent page.
10. Limitation of Liability
Capitari shall not be liable for any damages arising from: the denial or delay of your application; the terms, rates, or conditions offered by any third-party lender; any decision you make based on information provided through the Site; or any actions taken by third-party lenders or service providers. Our liability is further limited as described in our Terms of Use.
11. Changes to Application Terms
We may update these Application Terms from time to time. Changes will be effective upon posting to this page with an updated "Last Updated" date. Your submission of an application after any changes constitutes your acceptance of the revised terms.
